Terms and Conditions of Service, Waiver of Liability, and Release
Custom Manufacturing
The Client acknowledges that all products are custom-manufactured to the Client's specifications. Underdog 3D Printing acts solely as a manufacturing service and is not the designer, engineer, or manufacturer of the underlying design.
Design Responsibility
The Client is solely responsible for the design, dimensions, tolerances, functionality, safety, engineering, and intended use of all submitted files. Underdog 3D Printing does not verify, modify, certify, or validate submitted designs.
Engineering Certification Disclaimer
Printed parts are not certified by a licensed engineer, testing laboratory, or regulatory agency unless expressly stated in writing.
Regulatory Compliance
The Client is solely responsible for ensuring compliance with all applicable federal, state, and local laws, regulations, permits, and industry standards governing the intended use of the printed product.
Material Limitations
Printing materials possess varying mechanical, thermal, and chemical properties. Underdog 3D Printing makes no representation that any material is suitable for the Client's intended application.
Manufacturing Tolerances
Minor variations in dimensions, layer lines, surface finish, color, and appearance are normal characteristics of additive manufacturing and are not defects.
Inspection and Acceptance
The Client agrees to inspect all printed products upon receipt and notify Underdog 3D Printing of manufacturing defects within five (5) days. Failure to do so constitutes acceptance.
Risk of Loss
Risk of loss transfers to the Client upon pickup or delivery of the order to the shipping carrier.
Custom Orders and Refunds
Because all products are custom manufactured, orders generally may not be cancelled or refunded once production has begun except as required by law.
Limitation of Liability
To the fullest extent permitted by applicable law, Underdog 3D Printing shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the manufacture, delivery, or use of any printed product. Total liability shall not exceed the amount paid for the order giving rise to the claim.
No Recall or Ongoing Support
Underdog 3D Printing has no continuing obligation after delivery to monitor performance, issue recalls, or provide updates unless agreed in writing.
Right to Refuse Service
Underdog 3D Printing reserves the unrestricted right to refuse, cancel, or discontinue any order for safety, legal, intellectual property, regulatory, technical, or business reasons.
Electronic Acceptance
Submitting files, approving a quote, placing an order, making payment, or electronically accepting these Terms constitutes agreement and has the same force as a handwritten signature.
Attorney's Fees
Where permitted by law, the prevailing party in any action arising from this Agreement is entitled to recover reasonable attorney's fees and costs.
Survival
The provisions concerning indemnification, limitation of liability, governing law, confidentiality, and intellectual property survive completion of the order.
Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
